L’impresa comune come network di imprese: cooperazione vs. competizione
abstract
The present working paper aims to investigate all the different legal tools the Italian law offer to firms in order to achieve the benefits of the network organization of economic activities. Special attention has been paid to the new “firms’ network contract” introduced by the Italian legislator in 2009 and then modified in 2010; studying that contract has also been fundamental to develop a comparative analysis among so called organizational firms’ networks and horizontal joint ventures and to discuss about the supposed trade-off between competition and cooperation as drivers (and values) of progress and innovation in modern markets and knowledge-based economies, both in a scientific and a philosophical perspective.
