La responsabilità dei condòmini per le obbligazioni contratte dall’amministratore
abstract
This article examines the responsibility of the owners with regard to the obligations taken by the building administrator. While in the past it was believed that this was a joint liability, jurisprudence has recently changed its opinion, indicating that this liability is divided between the owners according to their own share of property. Moreover, the legislature has now tuned specifically this responsibility, indicating that each owner is bound to pay back the creditor the entire debt. However, before the creditor can act against the owners who have complied with their own share of payment, he must try to exact payment from the ones in arrears.
