dc.description.abstract	The author comments a recent decision of the Joint Civil Chambers of Supreme Court concerning preliminary preliminary sale of real estate, considering the nature of this "pre-contract agreement" and doctrinal thesis that have occurred over time. This paper aims to try to understand if the abstract eligibility of the preliminary preliminary dogmatically can be justified in terms of its usefulness to the parties and, therefore, of worthiness of protection of their interests in according with the art. 1322 c.c.

The author comments a recent decision of the Joint Civil Chambers of Supreme Court concerning preliminary preliminary sale of real estate, considering the nature of this "pre-contract agreement" and doctrinal thesis that have occurred over time.
