Abstract
The paper reflects the structure of general principles upon which the entire framework of the new Code of Public Contracts is built; this set of principles implies an innovative general vision of the public administration and its tasks, even beyond the public procurement sector. In particular, the Author dwells on the nomogenetic function of the principles and on the reciprocal relations between them, on the basis of which the principle of result is emphasized. Lastly, the paper reflects on the advisory function of the Consiglio di Stato, which is intended to guide the administrative system in times of uncertainty.
