abstract
The article offers a comparison between the Directive 94/45/EC of 22 September 1994 on the establishment of a European Works Council or a procedure in Community-scale undertakings and Community-scale groups of undertakings for the purposes of informing and consulting employees, and the Recast Directive 2009/38/CE. The author highlights the main innovations of the 2009 EC Directive, such as, for example, the new definitions of “information” and “consultation” or the content of the agreement between the central management and the special negotiating body, discussing strengths and weaknesses of the new regulatory text, and offering an overview of the worthier labour law doctrine about this theme.
