The Right of Access to and Enjoyment of Cultural Heritage
A Link Between the Protection of Cultural Heritage and the Exercise of the Right to Participate in Cultural Life
abstract
The present paper argues that the right of access to and enjoyment of CH is an emerging right under international law and can play a pivotal role in linking the protection of human rights, in particular the one to take part in cultural life, to the safeguard of CH. It will analyze the provisions of the international legal instruments which make reference to the concepts of access to and enjoyment of CH, the practice of the international monitoring bodies and human right courts which have played an important role in the definition of the right of access to and enjoyment of CH, and it will briefly examine the practice of some States.
